Easter cheers, reply to our critics

What with the sweltering heat consuming our physical energies, the Lenten week could have passed us here in the cavernous Batasan Complex with utter solemnity, creeping lonesomeness, and maybe crushing boredom.

Yet the inevitable working of human empathy made Easter Sunday turn up with doses of cheers for everyone, especially for me.

As Teddy has written in his Easter blog (inunahan mo ang ninong mo, ah!), I got the most pleasant surprise and the most liberal dose of cheer. Why? My mother, whom I thought I would not see during Lent at my birthplace in Dampul, came to visit me. Thanks to my office staff, led by Yvonne, who had tearfully read my first blog and decided to do something to surprise me.

Not only did Inang come shortly after 8am, spurring my wife Bobbie, who had stayed overnight, to excitedly rush me out of my office bathroom to welcome “our visitors”. Inang came with eight of my eleven siblings (four sisters and seven brothers) and several of my nieces and nephews. Later, my son Anto joined us, followed by my elder brother and his family. We had a grand time together; we savored the five precious hours till early afternoon strengthening bonds, updating on one another’s affairs, bantering, with our bodies heaving with laughter. It was as if the gleefulness of Dampul, our Lenten Mecca, had momentarily been transported to the Batasan.

My Batasan 5 colleagues, though wrapped in joy huddled with their loved ones, could not but be infected by the glee emanating from the largest group that was Inang’s brood. We all enjoyed the lilt of Easter under the copious shades of the tall bangkal trees on the edge of the South Wing of Batasan where Teddy’s priest-brother Peter celebrated mass, followed by pot-luck lunch. By past 2pm, the party broke up, with everyone leaving with a broad smile.

Now let me reply to all the agitated bloggers who kept asking: Why do we “hide” in the Batasan? Why don’t we “come out in the open to face the charges against (us)”?

Vinsoy and other sympathetic bloggers have partly answered these questions, and I am grateful to them. Allow me to dwell further on the matter.

First, we have squarely faced the charges against us. Actually, at this point it’s apt to call them what they really are: three separate complaints filed with the Department of Justice (DOJ) by the Philippine National Police-Directorate for Investigation and Detective Management (PNP-DIDM). The DOJ is trying to consolidate the complaints towards one charge of rebellion (the offense being one indivisible political act that must involve the use of armed means to overthrow the government).

Through our lawyers, we have questioned the validity – in both form and substance – of these complaints, and the relevance of the voluminous documents purported to constitute evidence of rebellion in two of these complaints. The third, according to our lawyers, cannot be considered a charge, no specific documentary basis.

After having laid the legal and practical bases through proper motions filed with the DOJ panel of prosecutors, we have elevated two issues for resolution to the appellate courts: the issue of warrantless or illegal arrest, applied in the case of Rep. Crispin B. Beltran and threatened to be applied to us, which we brought to the Court of Appeals; and the issue of the violation of our right to due process of law in the preliminary investigation on the complaints against us being carried out by the DOJ; that we brought up to the Supreme Court.

Second, we are not hiding in the Batasan as if we are fugitives from the law. We sought – and have been given – protective custody by the House of Representatives to which we belong, likewise by the Senate through unanimously adopted resolutions by the two chambers. The protection granted is for our right to preliminary investigation and against illegal or warrantless arrest.

Concurrent with such protection, we are safeguarded our right as members of the House – with a mandate from the people who elected our parties under the party-list system – to continue performing our duties by attending sessions and committee hearings of the House of Representatives. Should we allow ourselves to be arrested without warrant if we leave the Batasan premises, we would be prevented from carrying out our duties – as has happened with Rep. Crispin Beltran. Our constituents would be deprived of their voices in Congress arbitrarily through the act of detaining us pending conclusion of the preliminary investigation to determine if there exists probable cause to formally charge us in court.

That would be an injustice not only to us but to our constituents.

noong wala pa kayo sa kongreso, tinutuligsa ninyo ang pork barrel. ngayong nandyan na kayo, nagpapakasasa na kayo dito. hindi nyo ba ito pwedeng tanggihan para maging halimbawa sa ibang mga pulitiko o upang maging balimbawa kayo nang pagbabago na hangad ng nakakaraming Pilipino. nilamon na rin ba kayo ng sistema?

In my humble opinion there is nothing wrong in Pork Barrel perse but rather on the misuse of such fund that it contradicts to the common good of the people. Pork Barrel perse isn't bad but it was the corruption of the people within the bureaucracy of legislation that give such fund its bad connotation. While BayanMuna is Pursuing their full blast effort to protect the true essecne of democracy, i dont mind having my taxes go to their Pork Barrel.

THE TRAPOS ARE THE ONES TO BE BLAMED

It now brings me to my second point that the Arroyo administration is a hindrance to the fullfillment of progressive party list groups truest function as legislators serving the Filipinos. Just like what the administration did to Rep. Crispin Beltran, Arroyo magnified clearly that criticism is equivocal to what she likes to call "rebellion". Ka Bel's arrest not only was a clear representation of obstruction of his function as a legislator but another blatant attack to the democracy inhaled by each Filipino.

It is rightful for Bayan Muna and other progressive party list groups to engage in every struggle necessary to have the TRUE democracy be placed in the grasp of every filipino's hand. Not the democracy imposed today, NEVER THE DEMOCRACY OF THE FEW. Through the interconnectiveness of the Parliamentary struggle with the clear laments of the people in streets involved in protests, it will be greatly beneficial for the Filipinos craving for the fundamentals of a dignified life.

On the pork barrel issue,

It's intention is to help deliver something to the people through projects that truly benefit them. Of course, it can be abused, or it becomes the source of corruption. Depende na yan sa merong "hawak" kung paano niya ito ipatutupad. Kung magpapagawa lang ng mga walang kabuluhang projects tulad ng waiting shed, basketball court, o kaya ay isang multipurpose structure na nirequest lang ng barangay chairman na walang konsultasyon dahil sa tabi ng bahay niya ito ipatatayo, eh malamang na kapiranggot lang ang benepisyo sa tao dahil karamihan sa pork ay sa bulsa ng congressman nauuwi.

Dapat siguro ay maging transparent ang lahat ng mambatas tungkol dito. Gawin ninyong panukala ang transparency sa pamamagitan ng pgpublish kung saan napupunta ang pork barrel, at magkano ang nagagastos ng bawat mambabatas.

Merong isang proposal sa pork barrel na talagang kaduda duda ngayon kung maging batas ito. Ang pagdag na P20 milyon sa usual allocation (P40 milyon) ng mambabatas sa mababang kongreso. Sobra na yata ito. Hindi pa man nakolekta ang buwis mula sa EVAT ay pinagpapasaan na yata ng kongreso. Ganitong morality sa pork ang dapat tuligsain o busisiin. Sabi daw ni Joe De Venecia (ayon sa media), 3 kilometrong kalsada lang daw ito. Buti kung sa kalsada mapupunta, at kung dun man ay tila sobra yata kamahal na project yun, di ba?

Ito ang dapat tutulan dahil maliwanag na ang interest nila Joe De V. atbp ay palakihin lang ang pork nila at ituloy ang ligaya. Sana ay ibasura ninyo ito nina Ka Satur at Batasan 5.

Bakit pinag-aawayan ang Pork Barrel eh kung ihahambing ito sa nilulustay ng mga kampon ni Gloria ay maliit lamang ang hawak ng Batasan 6? Anim lang sila sa karamihan ng mga kongresista. Bakit hindi tuligsahin ang pagwaldas ng pera ng buong gobyerno? Katulad ng $10,000 per month rent ng consul-general ng Pinas sa New York -- at pito pang mga diplomatiko kuno na ang renta sa bahay ay umaabot sa kabuuan ng $500,000 buwan-buwan? US dollars iyan, bok. Times 50! O 25 million pesos buwan-buwan. Talagang aksayado dahil puwede nang pambili ng bahay. Alam iyan ni Aling Gloria dahil doon sa $10,000 per month apartment sa NY natutulog yung asawa niya pagka bumabiyahe. Para hidden daw from public eyes! Kaya lang, siyempre may grapevine ang mga domestics dito.

Ang pork ay isa lang imahe sa bulok ng Gloria regime, tulad ng magastos na Pinoy diplomats sa NY, atbp. LAHAT ITO AY MAY KINALAMAN SA IMORAL NA PAGLUSTAY AT PAGPAPASASA SA KABAN NG BAYAN. Pagsamahin ito lahat at maliwanag ang resulta: ito ang dahilan ng paghihirap at pabaliktad na pag unlad ng Pinas, lalo na ngayon.

kapag ang national budget ay automatic na maglaan ng 70% para sa social services tulad ng edukasyon, health care at housing ay mapatupad, kapag ang 20% ng budget ay mapupunta sa simpleng titser, nurse, doktor at pulis (isama mo na pati sweldo ng congressmen senador maging ng presidente since kawani rin sila ng gubyerno), kapag ang 10% na natitira ay gawing puhunan ng gubyerno sa pagpapatayo ng pabrika, tulay, atbp, at manindigang ang inutang ni makoy ay di dapat bayaran dahil kasabwat din ang IMF-WB sa pagduldulan ng utang na 'to.... then lets shout in unison na tanggalin ang pork.

Pero nasan ka ba ng mag file ng panukalang batas ang BM na magbigay ng malaking porsyento mula sa koleksyon ng e-vat para sa social services?

Now that the parliamentarians of the street are actually inside the congress you're accusing us of double standard.

you want the pork barrel be scrapped? then propose a law or whatever that the prerequisite for candidacy of any elected position is to first and foremost a candidate's waiver not to received a single centavo of pork. tell that to your congressman first.

Ako pinoy hindi ko sinasabi na ikaw si noli. Sa isang post ko, sinabi ko na kasama ka ni noli. Kung mayroon mang mga kasama who bunch you up with noli, iyan ay dahil nagkukunwari ka kasi na bumuto ng BM noong nakaraang dalawang eleksyon. Kaya tinitrace nila ang mga previous posts mo and if some of them came to the conclusion that you and noli are one, that is to support their debunking your claim na ikaw ay dating BM supporter. Hindi ko na lang isa isahin yung mga previous posts mo which reveal that you are not what you claim you are.

Kung totoo kang bumoto ng BM noong nakaraang dalawang eleksyon you would have placed the issue of pork barrel in its proper perspective. Totoo na may element of pragmatism sa pangtanggap ng BM ng pork barrel. Pero imagine pinoy. Sabi mo, sang-ayon ka na ang ND movement sumali sa parliamentary arena. In other words, sang-ayon ka na pumasok ang BM sa lion's den to fight out the lion in their own turf. Pero sa iyong pagdakdak sa pork barrel, gusto mong hindi tanggapin ng BM ang isang weapon that could help them fight the lions in their own turf. Kung wala kang pork barrel doon, pinoy hindi mo matapatan yung mga traditional politicians in getting the votes.

huwag mong imisinterpret pinoy ha na ginagaya ng BM ang mga traditional politicians sa paggamit ng pork barrel para bilhin ang boto ng mamamayan. Ginagamit yan sa mga proyekto para sa mga BM-bailiwicks at para sa expansion areas for organizing ng BM, Anakpawis, at Gabriela.

Is presenting views that are diametrically opposed to your view considered distorted analysis? check all the posts and you will see that most anonymous posters are Batasan6 bashers -- for now.

If you really do check all the blog comments that are answers to your pork barrel brouhaha, there are loads of opinions and data that give light to the issue that you are so infatuated, no, obsessed is the word for you, with no end in sight.

It is only obvious that you simply refuse to see these as explanations - simple and passionate for some of those who replied to your comments.

Come to think of it, hard-headedness does sow disunity pinoy.

If you persist on your pesky badgering on pork barrel, for comic relief, i recommend that you join the porcine olympics in moscow next year. the pigball competition still has slots for asia.

your previous posts pinoy. I find your position on the mining issue uncharacteristic of a BM supporter twice over. Next was your question, "kung majority kayo bakit hindi nyo pa napatalsik si Gloria?" I take that as a clue on which side of the fence you are. In your first few salvos, you also challenged the Batasan6 to come out which to me parrots the Gonzales-Lomibao line. If you want to disabuse me from such estimation, you are free to explain.

Second, I can not understand why the pork barrel issue remains a festering bug in your head when you claim you had voted BM twice. BM took their seats and started getting their share of the pork barrel in 2001. If your claim were true, I would imagine that you had gotten over it when you voted BM the second time in 2004. Otherwise, if the issue was so incongruous to your vote for being a deeply-seated conviction, you would not have cast your ballot for BM. You would have settled your scores with BM in 2004.

the PDAF as I see it pinoy can be likened to a knife on the table. In the hands of a killer, it will be used for murder. In the hands of a doctor, it can be used for surgery. The first can be likened to traditional politicians who use their PDAF to enrich themselves. The second can be likened to BM and other PPL which use it for genuine development projects.

What is BM to do when someone from Pangasinan comes to them and ask for help for his ailing child? Drive them away and tell them to go to rabbit-eared de Venecia so BM would lose their vote and they would vote JDV for prime minister?

BM areas are under attack from all fronts of the reaction, both ideologically, politically and militarily. If you would not put any BM-initiated infrastructure there, BM will become vulnerable to government and military propaganda that "it is doing nothing for the masses". If you would not put any project there, it creates a vacuum that will be filled up by GMA's own pork barrel and herd the masses away from BM. I concede that there is an element of pragamtism in the acceptance of pork barrel but at this juncture, it is political naivete to forfeit it to the trapos.
